My application criteria is as follows:- 620 credit score- 2.5-3X gross income to rent ration- no criminal background.If they meet all of that, and the references/information checks out...they are automatically accepted and I present them with a lease.If they do not meet 1 or more of the above, I work with them to get additional documentation and references if they are still interested.

Illegal is a reference to a criminal matter, the violation of a mortgage clause - absence of fraud - is a civil matter.Problems with this type of transaction occur in four areas1- If the lien holder decides to enforce the clause and accelerate the note. 2- If the buyer stops paying the seller, and the seller has to make payments out of pocket and due to foreclosure laws, bankruptcy laws, delaying tactics, etc., is unable to gain control of the subject property for a long time - in some particularly unfriendly creditor states 8 years is not unheard of!

Nor has anyone addressed whether or not it is legal for the park to deny a tenancy to a potential buyer if they have been prevetted, ie; they have good credit, no criminal background, no evictions of record and income 3x - 4x the monthly lot rent.
