The cheaper softer vinyl will get destroyed much faster, and as others have mentioned a clear coat of poly will be cheaper than a full resurface and finish. 

When I spoke with the contractor, he mentioned that the increased cost is because this would be a new driveway where I currently have a lawn and it's not an existing driveway that is being re-surfaced.

The holder of the current tax certificate is open to hearing my offer however, by due diligence, I'm curious if anyone's experienced a situation where, after the new unwarranted tax deed from the county is awarded, the previous mortgage lien resurfaces on the title?

Expect to have the problem resurface and pay to retreat if they are the source of the infestation.
