In my opinion,you should be speaking to an attorney about any liability on their part.To me it's a 50/50 chance of winning depending on the judge.Your argument is they deliberately disobeyed you after you told them not to turn up the temperature.However,they will argue you failed to replace a defective water heater with a new one that wouldn't have had this problem at the higher temperatures.It's a toss up.
