This would require the plan to allow for in-service distributions, something they could check on with the plan administrator if there were interested.Yes, the participant loan feature is the remaining option for them to borrow the funds from their plan and then they could convey these funds to you personally (via a loan or whatever arrangement you collectively decide on).

Tax deeds convey title to the purchaser free of all prior encumbrances (mortgage liens, judgment creditors, etc.) of any kind EXCEPT liens specified by Revenue and Taxation Code Section 3712, Lis Pendens actions and any Federal Internal Revenue Service (IRS) liens that are not discharged by the sale, even though the Tax Collector has provided proper notice to the Internal Revenue Service before that date.

All of these issues comes from not understanding the basics of real estate, rights held, conveyed, interests obtained, rights of full use of a property by an owner, what tenant's rights are held, conveyed and their responsibilities as well as owner's rights and what ca not be conveyed.

Again, I'm not saying that's unethical or immoral but, let's call it what it is and not give it any more credence than it deserves.Finally, i'd be very careful about conveying to a prospective tenant that they could get cash for keys as an added bonus/incentive to enter into a lease with you because, if they don't, you subject yourself to being sued by the tenant.

Just open up escrow on it and order a preliminary title report.. or title work or whatever they call it in your state..once you get the title report back it will have the true vested owner.. and if there is issue with the title IE to convey marketable title it will spell it out in the Preliminary title report.some call it a title binder  etc etc.. usually a few hundred bucks.
