Hello fellow BP,I own several rental properties in Atlanta GA and have run into a problematic tenant that has recently vacated one of my properties. the lease was for 24 months. she paid rent on time most of the time and fulfilled the complete lease ending on 5/31/2016.

She would only be able to get out of the notice requirement by somehow proving she didn't get the email, and never was "notified" that you were terminating the lease.And actually, if she's acknowledged your notice with the housing authority, that would prove she got notice, too.There is case law for Illinois, where the courts said the intent of the law is not to restrict the method of how you give notice, and that if the tenant admits they did get notice, then the requirement for notice has been fulfilled, no matter how it was done.http://www.illinoislegalaid.org/index.cfm?

As far as the marital issue, counseling or not, really listen to your wife about why she feels it is important to help this person, then see if you can come up with a compromise, like have him move but agree to volunteer with her at a homeless shelter nearby or something else that fulfills both her need to help with your need for privacy.

Ultimately if they can't pay and won't live together so they can afford the place you are going to have to figure a way to get your property back and rented to someone who can afford it.This happens all the time and it's not generally productive to try and make them fulfill the term of the lease.

I publish my qualifications and they are the same for everyone. there is no such law any where in the USA that you can get sued for rejecting a convicted felony or a eviction in the past you cannot reject for color, sex, sexual orientation or religion and so forth just make your rules clear and they apply for all and you never end up in court for such a thing. by the way you cant just tell them you just changed your mind that mean if you rent the apt to someone else any time over the next month your going to court to fight for a discrimination charge. make your own rules and stick with them for all.

Randy...It is protected and you cannot discriminate because of weight, color, religion, class, sexual orientation and all the rest But what you can do like we have done is set a list of qualifications and make sure everyone gets a background and credit check and make sure that everyone who rents from you is treated the same they must be able to pass the background check.
