The LLC can clearly demonstrate that it had the intent to hold the property for rental/investment purposes, but if you deed to you and your wife, you can not say that you had/have the intent to hold because you are going to immediately sell.

You must rent it long enough to demonstrate that you had the intent to hold as a rental property, such as 24 months. 

See if your attorney suggests a "release of possession" type of form to go along with the letter, with the intent of having the tenant sign that form to demonstrate that they no longer claim possession. 

If you can demonstrate you are the best way to do that then they will often work with you.If you can track down the owner you can also buy it directly from the owner.
