The point here is, in a non-judicial process there is no forum in the foreclosure process for a borrower to contest the presence of the note or the right to enforce the note by a party.  

However, if you are using the physical presence test to tax exempt your income (as I have been doing for the past three years) I could imagine that may cause some problems as your tax returns would make you appear to reside outside the US.

Normally you just sign in the presence of a notary then mail the documents to escrow?
