You cannot own "Queens Land" which is owned by the Navy and is the first hundred feet or so from any water source.

My daughter is going through her own tenant from hell experience but one big advantage she has is the renters are Navy and her husband is ex-Navy. 

And what that underlying issue is can be one or more of several different things; a French drain would typically come into play if the cause here is from water pressure of the surrounding soil.Backing out might have been the right choice.
