The lease states: Landlord agrees to make all necessary repairs to structural portions of the Premises, including the roof, exterior walls, foundation, and exterior sewer line.When preforming agreed upon repairs all the toilets were flushing and operating, not clogging.The tenant has been occupying the building for two months and emailed me yesterday saying that all the toilets were clogging.

But to be more specific, I saw gaps between boards in the flooring, bathtub drains with paint still in them from reglazing/aging, toilets left with feces, and numerous other very odd issues that are not rocket science for basic cosmetic flips that I shouldn't have to point out to an experienced CG or PM.

One minor exception to the comment: not advisable to lose Section 8 funding which could result both an immediate lose of further rents and/or a squatting/eviction scenario.Next:1) In terms of the late rent payment(s) - consider a 3-Day Notice to "Cure or Quit". 2) If step 1) ineffective, consider the lease type - in many states if month-to-month the lessor has the right to submit "30-Day Notice to Vacate" without cause. 3) If step 2) is ineffective, an Unlawful Detainer (aka Eviction) could be pursued.
