As long as the tenant receives it and signs a copy, you should be good.Certified Mail works because the Courts accept this as delivered even if the tenant never picks it up.

If it is an issue and you do not act in a timely manner AND there is some sort of legal action, then the courts will not look favorably on your response time.

This is also why two parties go to court or arbitration, they differ in their interpretation of typically very clear language in the contract and one or the other doesn’t want to honor it.

Just this week I sent an e-mail to her caseworker to notify the HA of our pending lawsuit to obtain a judgment for what she owns, and the caseworker confirmed that she will place the voucher on hold until the outcome of the court case, which prohibits the tenant from leaving until I confirm she is in compliance with her lease.

Lastly, while looking through the County Court Record I found a dismissed Eviction record filed this year Feb of 2024 on the prospect, the address listed on the record for the prospect (Defendant) is the current property they reside in but found another management company (RENU Property Management) as the plaintiff (this one was easier to look up as it operates nationally in several states).I usually have no problem with this as prospects usually reside in a known management company serviced in the area (Most are the typical corporate rental companies like First Key and Progress Residential, and some with the more known local management companies.).
