There have been many posts from "wholesalers" where they fail to respond to questions I pose because they CANNOT defend their actions or post. 

I'd suggest double-checking what you can and cannot deduct for knowing you may have to defend it in court.

Well I was expert for the insurer (co defendant with the agent).

So with the slip and fall case, the LLC could defend the homeowner by pointing to the lease and mgmt agreement where it says the mgmt company is responsible for all maintenance and upkeep including shoveling and salting sidewalks.

As you said, if you can show that it was sold at fair market value, then you should be able to defend yourself in an audit (should there be one, and probably if you are declaring a huge loss).
