The attorney would much prefer the property be sold prior to sheriff sale - saves the attorney's lender client lots of money when that happens (no poundage, no ejectment, no listing and sales commission, etc.).

Also.. was told by an attorney that if the amount is under $10,000, you can file a summery ejectment form in small claims.

In Kershaw County, We go to Magistrate Office with lease and sign the Affidavit and Application of Ejectment and pay $40 fee.  

Make sure you know what you are doing;  some states will require an ejectment rather than an eviction.

In PA that is an expensive ejectment action, so I prefer to get possession returned by the occupants "voluntarily surrendering possession" - cash for keys is the enticement for that.If your tenants aren't out on the 31st, you are close enough to the court date that you should expect to have to make that appearance.

If not abandoned, then you must give occupant written notice to vacate, but you cannot file your ejectment lawsuit until 6 months after the notice.

It should be covered somewhere, like in summary ejectment.

And it behooves Landlords to know what tenants are doing in Rentals, & eject those who are acting in criminal ways.
