I'm finding that 10 years removed from the mortgage crises, most lenders are still quite liberal in working with the owners and allowing them to stay in the house and make lower payments IF the owner is cooperating, responding to letter and applying for a Loan Mod.

If the tenant's aren't speaking to each other and one isn't cooperating and the lease indicates the deposit came from both of them even though the cashier's check did not, let us know and I can give you a story or two about that situation and which may be helpful.My vague memory is that I did not always do a walk through and it was never a "major" issue.

In that case only offer them a grand or two to cooperate with a shortsale or take it subject to the existing financing.If there is not then make an offer to purchase the property and the proeprty taxes and remind them otherwise it WILL foreclose and they will have nothing.

If there is a big spread there, then it gets interesting.To get this deal done you will need to be able to get cooperation from the husband and the wife (not necessarily cooperating with each other, but both must cooperate with you.)

My concern is that I am not able to do a property inspection because the tenants are not being cooperative they are going thru eviction.
