I'm not an attorney, but a simple dictionary will tell you that fraud means you intend to deceive someone, it means that what you tell them is not consistent with your actual intentions (you have no intent to perform), and that the deceptive behavior is expected to result in financial gain by the fraudster.

Although behavioral patterns can be used to simulate or predict when anyone is in foreclosure or is likely to BE in foreclosure, as I said before, foreclosures and absentee owners and etc. etc. doesn't induce motivation.
