Document EVERYTHING... every conversation, every contact, every document from the remediation company etc etc etc.Then I would send him a certified letter that states all necessary precautions, accommodations and solutions were done.

this is great, thank you. others have said the same, so counting the sofa bed as a bed is out. thank you for the insight. regarding the septic, it's rated for the number of bedrooms in the house, so it is fine. i will probably pump it more often, as a precaution. i just think less wear + tear on it is better.

The situation resolved itself because they decided to move out, and as a precaution I took up the new flooring, installed a vapor barrier, and installed new flooring on top (painful since I had installed it all a year before, but in the end it really just came out to a few months profit).
