If someone is abusing it or misusing it and taking advantage of people with it, then I think they should be sued.

Leak wasn’t a gusher, just a few little drops every 8-9 mins… Also is the toilet wax ring/bolts/supply line replacement- which was not due to misuse or abuse or damages, just age-the responsibility of the moved-out tenant to pay (taken out of security deposit)?  

Any suggestions for how to structure the lease so I'd be responsible for normal wear/tear but they'd be for misusing it?

THe accountant will make it fly, but an attorney would probably say you are misusing hte LLC. 

Realistically it is a pretty minor change, but, SOME Tenants will go to great lengths to make a mountain out of a molehill.If your existing Rental Agreement has language addressing drainage issues and for holding Tenant responsible for misuse or abuse of fixtures and systems, simply provide them an invoice for repairs caused by said misuse (after you have properly given written notice of the "proper care" of Septic Systems.)
