If the seller refuses to allow inspections, read your contract and use whatever contingency you need to in order to get out.The "hardly waits" is an expensive disease that causes you to ignore warning signs and make bad decisions.

As long as the tree was somewhat maintained, and there was no visible sign of issues (rot, disease, etc.), then there's very likely no liability/negligence on your part.

It sounds to me like you've got a bad case of Cardoneitis- that's a disease that entrepreneaurs get when they keep being told that they need to go big or go home, but their goals are nebulous and so "going big" is impossible because you don't have your short term, SMART goals in place.
