If you must, you can do a note and deed of trust with another agreement as a deed in lieu of foreclosure, that would provide him with the right to simply file a quit claim deed as a deed in lieu, say after thirty days (however long a foreclosure sale would take in your area), after notice of demand as required under the security agreement/deed of trust.

im laying out the situation so that OPINIONS on the situation can be given. i told the owner i wanted a land contract deal up front, and he submitted this option to purchase thing, which, like you said, he bundled with basically a lease, creating a lease option. soo, to eliminate any problems, im gonna demand a land contract, with the terms all in there, and if he balks, just walk away from the deal. there is no VALID reason he should balk at the land contract, since he wants to go that route anyway after a year, according to the terms of the purchase option.

There will always be demand as student housing, and it's a quiet complex (not dominated by students), so down the road I may wish to rent to older people who are stable, want to be near a medical facility, don't want a yard to take care of, and won't move as often.

Is it just common knowledge that it starts at $500 and some investors pay more, or as a bird-dog can you demand a certain fee and hope they don't cut you out?
