They will supposedly first pay you back your initial earnest money with interest within four weeks of signing their NEW RELEASE AGREEMENTS as a show of good faith if you get in touch with their attorney (send me a private message so I can send you instructions to get in contact with their attorney), and then the remaining outstanding deposit with interest within two months after that.

we take contingent offers.. but we do require 10 to 20k non refundable release to us.. if they dont have the cash at closing then they lose the deposit .. but we dont sue them to perform. out of about 75 sales now.. we have seen probably 5 or 6 fail because their current home did not sell.

Call the police agency that responded and get the police report numbers for the reports before the hearing, they will not release the reports to you, but they will to the district judge.Show up at the hearing, explain the situation, give the police report numbers to the judge.If they check out, you will usually get an order of judgment immediately.
