While that is good for lenders, since the process can possibly be less than 30 days, while other states could take years. it's a hazard for 2nd lien position holders who could not be informed quickly enough to safeguard their principal before the senior creditor forecloses or don't have the capital available to pay off the 1st lien holder to preserve their loan position and avoid foreclosure.

The mortgage (and other lines) would likely be wiped out (but talk with a real estate lawyer or title company to be sure, I am not one) - which is why mortgage holders usually require an escrow account so they can pay the property taxes.

Part of my business was providing loan servicing for seller financed transactions and this type of intervention between a borrower and seller, I would have to say, was more than welcomed by underlying mortgage holders (banks).

I've yet to have anyone on BP articulate to me how an LLC in one of these states perceived to have greater privacy protections will prevent a plaintiffs attorney from suing the deed holder in the event someone is injured on your property amongst the various other common claims a property owner is subject to.
