I'll draw up a new lease giving me development access while setting aside a 'residential' portion of the land for the tenant and see if I can make this a condition of the offer to purchase (and feel the tenant out on this during the pre-offer inspection).I'll also review the KY Revised Statutes (or check with an atty) to see if I am on firm legal ground with that approach.Turns out the tenant was on lease in the past, but it has expired and gone to month-to-month with no quibble from either party.

I think the big liability is if you have partners who decide to sue you or if you sell off the property before the 10 year statute of limitation on construction defects.I don't think Johnny bucks are going to get you to a 20% down payment but they might cover a portion of your down payment.

The Prosecuting Attorney for Pulaski County issued a press release indicating that his office will not enforce the new criminal eviction statute and will not issue the 10 day Notices to Vacate.

For the bank account for the security deposit, the plain language of the relevant statutes requires you to place the money into an "escrow" account after several years (I think two years, but I don't have the statute in front of me).
