And simply wont sign to give the EMD back.. then you have to litigate for it.. who is going to hire and attorney or a 1 or 2k dispute only a fool would do that.

However many counties wont enforce them and if they are real old like ones that did not allow certain races and relgion to buy those of course cant be enforced.However a land owner in the same subdivision can bring a civil action to enforce these.

The tenant filed a fair housing complaint and has been successful so far. 1 HUD violation = $21k+ 2nd HUD violation = $40k+ civil penalties to HUD.

A driver of the litigation was this exact point aka "steering."

It would be a residence, and most brokers won’t be able to fund it with a DSCR either due to the litigation issue.

If litigation was enough to make someone not do something then none of us would ever do business. 

As an old civil engineer I’m not confident that all those penetrations through shingles and membrane would stay water tight.  

There's an entire semester-long course in law school called Civil Procedure (the absolute worst - *shudders with fright at the memories*) about figuring out the answer to that question based on the facts.

I don't foresee any advantages to litigation in your case unless you can demonstrate the work was done incorrectly which doesn't appear to be the case.
