In A Texas Eviction, the Judge will only award past due rent, Court costs, Attorney fees(maybe or maybe not) and post judgement interestHowever a separate civil suit for late fees, damages and other expenses maybe filed.

Potentially if you get a judgment and they don't pay you could extend the judgement to real estate they own and you might get payment when they sell or refinance that property if they do it within the next 10 years....they may never pay....so then you will be out time and money to file the suit and payment to serve them.

That is very cheap compared to losing 3 more months of rent plus the attorney fees, aggravation and time dealing with the attorney and going to court.I always win in court when evicting tenants and I got many judgments for $8,000 to $9,000, but never collected on one judgement.

Not sure if that is the same process as a non-payment eviction.That said, if you terminate, I would still file a non-payment eviction case in order to get a judgement.

We can file with the magistrate and go that route but one has to weigh the chance of getting blood from a stone even with a judgement . . .I know some states make it easy but PA is not one of them.What we do want to do is to try and ensure the next landlord does not find out what great tenants they can be.
