My take on this is that I would inform the bank and get a written statement from them that they give permission for the transaction.From what I have read, and from talking to an attorney, banks would rather have a performing loan than an REO.

I understand your concern, right now the banks don't care, but if interest rates start going up a lot I could see the banksters looking for wraps and ownership transfers to accelerate loans and force them to refinance into higher rates, so get permission in writing.
