Judge awarded tenant $70,000 and ruled that the tenant shouldn't have been charged rent since the unit was illegal (not up to current safety or fire code) and didn't give the landlord a chance to remediate the unit. 

Most every perm lender will want these remedied and the appraisal to be revised to "as is" before they will finance it. 

For example, the notice to vacate must comply with state and local laws, and the tenant is usually given a certain number of days to either remedy the situation or vacate the property.

Why spend extra weeks or months going to court when the law already provides a remedy?

Sorry for some reason I assumed you would be the 100k all in price, if so yes INS is 1kish, What if your tenant has a kitchen fire and you need to rebuild/remediate?

If the deal works then I would execute but I would include remediation costs based on an estimate from a contractor.

This is one of those issues that sometimes the only way to solve is to non-renew an offending tenant, as the only other remedy is to evict them using a 10 day (mission impossible). 

If the OP wish's to escalate this to civil court remedy.

Old homes have their issues but everything can be remedied.
