Your explanation of rental property sale losses being capital (not ordinary) losses implies that it is not considered 1231 property.But IRS Publication 544 states:Section 1231 transactions.The following transactions result in gain or loss subject to section 1231 treatment.Sales or exchanges of real property or depreciable personal property.

Account Closed Using the numbers in your example (which implies you fall under the income limit for deducting passive losses with active participation), your rental loss of ~$13k would wipe out your W-2 income in full and generate a ~$3k NOL, which would be carried forward.The standard deduction and personal exemptions (remember, no more personal exemptions starting in 2018) are irrelevant in this case.

Not implying your agent is taking advantage of your beginner knowledge just to offload a property and get dual agency commissions, but again, might not be the worst idea in the world to have someone in the Bigger Pockets community who's local/understands the Charlotte market to take a look at the deal you're getting ready to move forward on.As far as inspectors, I would recommend one that we use for our business that is in the Charlotte/surrounding areas.Precision Inspection Services - Steven Lee - 704-575-2917
