I just received a letter from the City regarding one of my rental properties for a court hearing because I missed a hearing they scheduled on the 7th.I received a letter a few weeks ago with some minor violations and one expensive one which includes.Missing smoke detector on second floorMissing handrailYard wasteBuild code conforming garage ( there is no garage currently).I didn’t look at the original letter closely enough to realize I was supposed to appear in court on November 7th to discuss violations.I have never been ordered to court before to discuss housing violations so I just assumed they wanted me to get these issues corrected.Now I have a new court date based on yesterdays letter.

Another thing to keep in mind as you start this journey is that much small MF here in the Atlanta area is non-conforming, i.e. a duplex with an un-permitted basement finished into a third unit.

They have more flexibility with these products since they hold them in house and don't sell them on the open market hence don't have to conform to certain rules.

It would fit conforming guidelines and wouldn't be a hinderance to most lenders to finance...If the city says no and if trying doesn't get approved, then tearing one down may be the only other alternative...Cheers!

Zoning dept. says we don't need to do a ZLA, but from what I have seen, the lots generally get split, even if they're not conforming zone lots.
