We have already spoken with a lawyer and have put things in motion by presenting him with a vacate notice treating himas a tenant, but it probably won't hold up in court, we are just hoping to scare him out.

One more hint... remember, there are inexpensive Motion activated cameras you can buy (some with audio) to record such activities (dumping, bottles, noise, etc).

Given that it is their attorney who is handling the eviction and has already filed the motion though, we weren't sure if it is best to wait until we can actually evict the tenant or whether we can switch to a different manager mid-stream.
