@Andy Bondhus this is where I said earlier I may have been mistaken on specific timeline of execution - original purchase agreement signed Tuesday at 5pm, then Option to Purchase contract signed the following day on Wednesday at 4pm along with an addendum and amendment.

That is a simple fix via amendment in contract.
