Long story short...the person whose name was on the title was not cooperative and we have since had to take legal measures to do a quiet title action that wont be completed until mid August.

I think you can document you did everything within reason - i.e. you had it professionally treated prior to move in, you had it professionally treated again when they complained of a problem, and you attempted to follow up professional treatment but tenant would not cooperate. 

Or wait it out if they will not cooperate....moving is a pita so don’t be too surprised if they resist, hoping the other side takes it.

But with a lender, I don’t see you getting this done unless the lender cooperates.
