The insurance company's defense states that since building B is not covered by earthquake insurance, the liability rests either on the owner of building B, or the contractor who built building B.

One of the common (and weakest) defenses of amateur APers I've encountered is that they are cleaning up or bettering the property and/or the neighborhood.
