I put $500 earnest money and bank countered and I accepted counter . they stipulated that if I could not close by 8/20/12 they would be entitled to $100 per day. i am ready to close they cannot get title cleared in time and title company now estimates not closing before 08/28/12 as there is an issue with sheriff sale not being recorded properly.

Because he mentioned that he had seen one of the properties a few months ago when it was in foreclosure (made an offer but didn't get it) and he was willing to cut his contingencies to 1 day of due diligence and nothing else.The buyer who offered $206K had LOTS of contingencies and stipulations, including 10 days due diligence, appraisal, proof that the subdivisions would allow the houses to be rented, we had to provide clean termite letters, we had to have utilities on for inspections, etc.

I am by no means a wholesaling expert however, if you use an exit strategy of "assignment of contract" your investor buyer signs (as do you) a form entitled assignment of contract which stipulates that they are to take over the purchase contract and pay you a fee.Keep in mind that your buyer will have to be an all cash buyer, or at least pay the assignment fee in cash as a lender will not loan on the purchase price + assignment fee (in most cases that I am currently aware of).Your other option is to double close which involves you having a title company willing, familiar, and able to do them.

So on my offer I had to stipulate that I would allow the seller/bank to cover closing costs up to 3% only (no more), because most mortgage companies view anything over 3% as a red flag that the buyer doesn't have enough cash for the transaction which increases the loan risk.
