The tenants that I've had have all had solid jobs....Neo-natal nurse with 2 kids (successful garnishment), two women/one kid who worked at Emory in administrative roles, hotel manager/4 kids (current lawsuit) and a single marketing rep/no kids.

Because my wife and I own the company together I thought about making her a majority owner in order to consider minority/women owned business grants etc but I really don't know if there is any advantage to that.Although we never want to assume a partnership will end badly, it is very important to have a well written agreement in place spelling out details of what will happen in such case.

Upon default being made in the payment of sums of money herein agreed to be paid, or in the performance of any of the covenants or agreements herein contained according to the terms hereof or of the Mortgage Note secured hereby, the holder of the Mortgage Note is hereby authorized and empowered to sell the Property or cause it to be sold and to convey the same to the purchaser in any lawful manner, including but not limited to that provided in Chapter 32 of the Revised Judicature Act (MCL 600.3201, et seq) entitled "Foreclosure of Mortgage by Advertisement" , which permits the mortgage holder to sell the Property without affording the Mortgagor a hearing, or giving the Mortgagor personal notice; the only notice required is to publish notice in a newspaper of general circulation in the county in which the Property is located and to post a copy of the notice on the Property."

The negotiators are not empowered to remove it based on conversations I have had.My thoughts are that BOA will not actually pursue the collections, but the investor or a collection agency will pursue collections post closing.
