The day before closing you’re told that some detail of the property previously undisclosed was revealed in the appraisal, and although the lender rather not make the loan, they feel bad for you, so they’re willing to make the loan at 14% interest and 6 points, at 60% LTV.Most times these unethical characters try to cover themselves legally by having ‘subject to’ language in their loan approval letter, as in subject to a satisfactory appraisal, subject to no change in market rate of interest, etc.

It is often at this point that whomever was technically first to apply may be revealed to not have the money ready to proceed right then, when the other party does.Beyond that, I'd normally be inclined to go with the couple that has dual income and a more established credit history; however allowing bills of $500 & $160 to go to collections needs to be questioned - and if accepted as tenants, I would require a larger deposit for that reason.

If issues or problems with the proeprty are revealed that were not obvious or previously disclosed during your inspection, you can back out and get a full refund of your EMD as long as you do it WITHIN the due diligence period.

Odds are, you didn't actually read every word of either appraisal, so who knows what little nugget the appraiser's research revealed from two appraisals ago that's buried on page 18.Let's say X years from now you go to sell it or refinance and there is some question about a zoning or use code thing.
