My understanding is that if the buyer signed a brokerage agreement with an agent, and a sale transpired (regardless of whether the property was or wasn't listed on MLS), then that agent is entitled to a commission.

The fact that a lender funds the transaction for the buyer and the Realtor is then paid the commission (which is usually more than the 1% stipulated in RESPA) a benefit has transpired and is gained by the Realtor.
