The property is not under contract, so I'm hopeful that I still have a shot but will not go above the price that works for my numbers. The property is cheap enough so my plan is to do a cash deal and then re-fi out once I rehab and the title seasons. My #'s have it cash-flowing at 265/mo. (2bd 1ba - could potentially be a 3bd which would be a huge win). Thanks in advance!

I didn't listen to Brian's video (I still say he needs to dress better and get a shave (lol)).A letter of intent is used in larger commercial deals, it's been adopted by gurus or others as a step adding to the unique approach as a ploy on a few fronts, but seller's really don't need to look at letters of your intentions to do something, they want to see you belly up with a real offer.

Don't confuse the low % down payment with being a better deal, you will get creamed on monthly payment compared to a traditional 20% down mortgage and the required PMI (insurance) FHA makes you pay will further eat your cash flow.3.

A frivolous lawsuit may be avoided when a contingent fee attorney has to go the extra mile to pierce an entity. That is a very good point. The good old ambulance chasers aren't usually the cream of the crop attorneys so don't really want to put in a ton of work that they very well won't get paid for. This is really what I think the biggest benefit to the whole entity and trust structure is making it a PITA to try to sue you.General thoughts on things are:1) Nothing is really going to help you much if you actually do something wrong be it malicious intent or gross negligence (This will include insurance)2) If something bad happens but you didn't really do anything wrong insurance will be the first line of defense always.

Depending on how the Trust is setup, Wholesalers would be wasting their time and Rehabbers would end up likely having to pay a higher price for the property. The Trustee(s) have a responsibility to the beneficiaries of the Trust.
