From my interpretation it says that any additional funds made beyond the fixed interest rate (which must still be less than the 10% usury limit) that are tied to the appreciation (or profit) from the sale of the property are not counted as additional interest for the purpose of the usury law.

Now my dealings with regulators are far more complex and had to do with securities and my attorney gave me some bum advice.. and they are a top law firm.. attorney had his position the state had theirs.. and it was off to administrative law judge if we wanted to change the states interpretations ..
