If you do not have protections on the fee then when negotiations get tough between a buyer and a seller they often times try to look to other fees they are paying to lessen them for relief.

However, fast forward 9 months after non payments, and us filing Motions to Dismiss and Relief, we finally received a prorated lump sum towards their arrearages along with their past regular mortgage post petition P&I, as they miraculously came up with a huge payment to save them from being dismissed.

There is automatic stay and it is not lifted until discharge or, until a motion for relief is filed, held, and found in favor of the creditor.

If you're worried about the risks, you'll have to get horrible Obamacare or go pay $1500-$2500 a month for a plan that makes you pay another $8000 out of pocket before you get any relief but they can try and not pay as well if you have some ridiculous injury/health problem.

Typically, the bank will get a Relief from the Stay of foreclosure in the beginning, and proceed with the foreclosure/auction while and if the borrower is casually completing the BK.
