The penalties for this infraction can be severe, and in a worst case scenario you wouldn't want to have to defend yourself against the federal government charging you with a crime and separately either party or both pursuing you for professional misconduct.My recommendation would be to first check with your broker to insure you don't run afoul of their internal broker/agent policies.

So I use this clause to make it clear that kind of behavior is not acceptable, then in the future as I was taught I can mail a copy of this clause from the lease THEY signed and ask them to cure the infraction.

It's my understanding that you're supposed to consider exceptions to things like minor old criminal infractions, or it could be seen as discriminatory, but the political climate for that may have changed somewhat recently.

Being an insider to the valuation industry, I can tell you these infractions are thousands, maybe millions of occurrences.Further, it is likely required a BPO be developed by a broker, not an agent, but don't quote me on that part, just food for thought.Abuse of this will likely continue until enforcement happens, which has so far not happened.
