I'm not a legal expert, but I do not believe you would have much basis for a lawsuit either unless te original listing said explicitly that the seller was responsible for U and O.

I dont invest in big cities at all, te largest I own in is 50K population, only because I know that town, but I prefer towns under 20K people

The loan is quirky only because te borrower is a non-recourse LLC but it is guaranteed by the client who does not have have title to the new property.
