The judge will mediate for the consumer an agreement where one creditor waits and it allows all the rest to be paid on time then the other creditor gets paid thus solving the insolvency problem without the need for any debt to be forgiven (bankruptcy).

I want to know that if I'm working on this deal, my efforts won't go to waste by having the deal ripped out from under me.Standard Real Estate ContractPros: legal and binding contract, clearly defined consequences for breach of contract, and the best way to secure your interest in the deal is with a standard contract (if you end up in court or mediation, you will have a more solid position if you have a signed contract as opposed to just an option.)Cons: time consuming to review with sellers (especially unexperienced sellers that don't have any knowledge in real estate contracts), can be overwhelming to some sellers, and some sellers won't sign a "contract" without their attorney getting involved (most of these sellers, though, will sign an option agreement if it's explained to them as a "marketing agreement".)

As stated court costs can get very expensive.It's better to mediate out of court in many cases.The question is do you think going to court after expenses you will be off better than settling out of court??
