While there are other properties operating in the legal grey zone, I'd be very cautious about investing a large sum of money on the assumption that the rules won't change against you.

You might also allow the tenant to sublet that area,  but that is very risky for lots of reasons,  and this would constitute a (very) grey area in the law.In situations like this the biggest risk of getting 'outed' is probably the neighbors.
