What matters is if the contract says it's a 2000SF house but its really a 1000SF house (as shown by a survey or similar, not the tax records)Normally when you put down non refundable deposit there is an understanding that you've done some level of due diligence.

Townhomes would probably require more work on your part due to the property lines between units would require additional surveying work, I would think.
