Regardless if the contract saying she is out the money or not, just give her her money back and be done with her, just make sure you get the lease cancellation in writing and have a signed receipt from her acknowledging she got the money back, and getting it all notarized is a good idea, then change the locks.

There are other companies besides SmartMove that you can use, I like it because it takes me out of the equation completely with regards to collecting that fee, entering information, etc.I wouldn't accept an in-hand credit report if it said their score was a thousand and it was notarized by God.

Thank you for the overwhelming support and feedback.We do have a renters addendum in effect, (signed by the tenant and the manager and notarized) which specifically states, EMPHATICALLY, that the rent is due on the 1st and can be paid anytime prior to the 1st.
