WHAT TO DO WHEN A TENANT SIGNS A LEASE AND WANTS TO CANCEL IT IN 5 DAYS?
Hi,
A tenant looks at the place while it was in move in move out clean up. She signs a one year lease on July 11th and the move in date was set for July 17th. She gave me $500 cash at lease signing $366 for pro rated July rent and 164 of 200 applied to non refundable pet fee. She has over 800 credit score, a good job making $50,000 a year plus are part time job, verified employment etc. I was even flexible to waive the $20/month pet rent and give her a couple of weeks to get her deposit since she just started working at the hospital.
When she saw the place I had mentioned that if the place needs to painted I'll paint it and she can pick the color. My cleaners did a great job so the place didn't need painting. When she got the keys she said she was unhappy with the place and we did a walk through next morning. All her concerns amounted to were loose towel bars, light bulbs, blinds, ceiling paint touch up etc which I immediately said my handyman would come fix it. All the issues were fixed in 48 hours. During this entire time she is extremely condescending, disrespectful, yelling and screaming and I have recorded it on audio.
When she finds out I am the property manager and the owner, she wants to cancel the lease and wants her $500 back. The lease states that unless you have military orders you cannot cancel the lease which she was aware of. I gave her options to
1. Complete the lease and move out
2. I'll cancel the lease but I cannot give the $500 since it will cost me time to re rent the place.
3. We can proceed the legal route of eviction.
I'm willing to meet more than halfway but she wants everything her way. She even sent her friends pretending to be potential tenants to document if the issues have been fixed. She has the keys so she has possession even though she never moved in.
What should I do? State law says I need an attorney to evict someone if I have an LLC.
