i have an interesting question for anyone who can educate me on this. here is the scenario:i have found a " zombie house". owner moved out when the bank started foreclosure. the bank is not maintaining the property and has not completed the foreclosure process and taken title. the house is in disrepair and i am thinking the bank does not want to foreclose and take possession because the place is no where near the amount of money they would need to get out of it. my question. if i were to purchase the legal owners intrest in the house, could i push a foreclosure on the house and force the bank to act, or not act on their intrest?

A frivolous lawsuit may be avoided when a contingent fee attorney has to go the extra mile to pierce an entity.That is a very good point.The good old ambulance chasers aren't usually the cream of the crop attorneys so don't really want to put in a ton of work that they very well won't get paid for.This is really what I think the biggest benefit to the whole entity and trust structure is making it a PITA to try to sue you.General thoughts on things are:1) Nothing is really going to help you much if you actually do something wrong be it malicious intent or gross negligence (This will include insurance)2) If something bad happens but you didn't really do anything wrong insurance will be the first line of defense always.

Of course, the police basically told her to stuff it.Oddly, she claimed that the Marshals who had served her every step of the way were actors hired by us to harass her, and that all of the court paperwork was forged.She genuinely looked stunned when everyone showed up and started moving her.Ah well, it's over.

I am not sure if that came with the JOBS Act or not, but it is what I have heard.The rub is that when the SEC issued their opinion on things late last year they now want people to have to verify accreditation if they publicly solicit money under the new Act.
