If you own the land with the easement running across is (the servient owner) you could have an attorney help you abandon it or transfer to another entity that you control that is different than the entity(ies) that own the subject property and the dominant tenement property.Alternatively, the easement could be modified into a license.If you really want the easement to go away and it turns out that you don't have control of it, hire an attorney to file a quiet title action.Hope a prescriptive easement has not been created by other third parties using the right- of-way for ingress and egress to another area, like beachfront property owners here in CA have to contend with.I'm no expert on entitlement, so your local real estate attorney will be a good source.

So I'd contend that for a rental this is a strong amount of leverage and as much as most prudent investors need anyway without taking on undue risk.If someone wants to wait 6-12 mths to TRY and get all of their cash back out at that point (that is, if the appraisal will support it), certainly they can do that.
