Accidents do happen, but its not criminally negligent.

So even if you pick a state with stronger protections like WY or NV, the cause of action arose in the state where the tenant fell, so likely that the court where the accident happened would have jurisdiction.California tends to have more laws on the books and requirements and restrictions that it can be a good idea to form a CA LLC for out of state property so that you as a CA resident are covered, and to try to have your contracts fall under the purview of CA courts.

That said, make sure you have Umbrella insurance to cover potentially liability issues due to "accidents."

I had a tenant pay his rent in 2 separate payments ($650 and $25) on accident.  

Such as smoking and leaving a cigarette out which burns the house or some unfortunate accident.

One of my concerns is the umbrella policy can be canceled, I've heard stories about issuers canceling if you get into a car accident or speeding ticket (increased risk).
