At that time I did let the tenants know that this service call was not due to normal wear and tear, but to tenant misuse, and that had I been charged I would have billed them for it.Today I get a call from my repair man.

This is why we usually do this during a renovation.As for repairs, they would be our responsibility, unless we can prove misuse, just as with any other appliance.

@Austin Largusa The property and the lease/tenant are two distinct items...so, unless you are dealing with a property owned by the housing authority or their subsidiary, built with tax credits or receiving tax credits, it's not a section 8 property...and section 8 is really a mis-used term...it's actually called a Housing Choice Voucher and they are used across many populations from at risk of homelessness, to corrections re-entry...to house veterans, etc.

Send them a Notice To Quit For Reasons Other Than Non-Payment of Rent and state that they have repeatedly violated the lease terms by their personal misuse of the common areas.
