If there was a defect for high cost loan, through a modification you can have the borrower affirm to not be able to look back and use any event prior to the modification as a defense in the future.

If I can't work to create a win-win with the borrower on a reinstatement, trial payment plan, or loan modification, then I have to look at deed in lieu of foreclosure or potentially end up foreclosing on the property.
